RESPONSIBLE FOR DATA PROCESSING

Booking-Kroatien.de, Miljkovica V 41, 23234 Vir, Croatia, OIB: 05294598680 (hereinafter referred to as Booking-Kroatien.de).

Booking-Croatia.com attaches great importance to the protection of your personal data, and the Privacy Policy (hereinafter: Policy) regulates the handling of your data when using the Booking-Croatia.com Internet portal and our services.

WHAT DATA DO WE COLLECT AND HOW?

Your privacy is important to us, which is why we only collect the data required for:

  • the provision of services and support,
  • the improvement of your user experience,
  • improving content quality and preventing fraud or the publication of illegal content,
  • compliance with legal regulations, including EU Directive 2021/514 (DAC7) and the Digital Services Act (DSA).

You provide us with data by filling in forms, submitting legally required documents or on special request. We also collect data automatically when you use our services or receive it from external sources when you use the services of our partners (e.g. payment confirmations).

We collect data that you provide to:

  • registration, advertising, booking accommodation, completing surveys, questionnaires and other online forms,
  • the reporting of illegal content and the collection of legally required documents,
  • communication with other users,
  • the provision of support, advice or complaint handling,
  • payment for services or refunds,
  • other activities.

In doing so, we collect your name, address, contact details, personal identification number, user account, optionally a profile photo that you use, IBAN or other financial data if you use paid services, date of birth and other data required to use the services.

Read in detail what data we must collect and process in accordance with EU Directive 2021/514 (DAC7) and the Digital Services Act (DSA).

We may also automatically collect data that is available when you access and use our platform:

  • Geolocation data and cookies, if you have consented to their use,
  • Information about the device you are using (model, unique device identifier, mobile network, etc.),
  • Usage logs, which may include IP addresses, time and duration of access, browser type, method of accessing our pages, pages viewed or features used in the mobile app, errors during use, etc,
  • Content, time and duration of a telephone call as well as the telephone number from which you are calling,
  • which services you use, when and how.

We may collect data from other sources:

  • from other users (e.g. comments, ratings, abuse reports, customer address for shipping, guest data, etc.),
  • from external partners who are responsible for data processing as part of the service provided (e.g. the number from which a payment was made by SMS, verifications, support for reservations made on another portal if you as the landlord are a registered user),
  • from social networks if you have linked your account to a social network account (e.g. user name, telephone number, e-mail address and other data for which you give us your permission).

For the collection and processing of special categories of personal data, such as sexual orientation, health status, religious beliefs, etc., we will obtain separate permission from you.

Our services are not intended for persons under the age of 16. If we become aware that we are processing such data, we will close the user account and initiate data deletion. If a guardian of a person whose data we process contacts us and identifies themselves or has access to personal data via our system, we may change the data at the written request of the guardian. We recommend that all parents and guardians educate their children about the safe and responsible use of personal data on the Internet.

HOW DO WE USE YOUR DATA?

We process the data collected and the data received as part of our services exclusively for the following purposes:

  • the purpose for which they were transmitted to us,
  • the purpose for which you have given your consent,
  • on a legal basis: by applicable legal regulations, legitimate interest, consent or the terms of use (contract).

We may use your personal data to provide you with:

  • to provide information and support,
  • to enable and facilitate the use of our services and our Internet portal,
  • customize content and offers to your interests,
  • surveys and adapt to your needs,
  • To inform you about new services and updates,
  • to provide information about events and special offers,
  • prevent fraud or other prohibited or illegal activities,
  • protect the security and integrity of our platform and your data,
  • perform business and statistical analyses,
  • develop new services and products,
  • fulfill legal obligations.

We do not sell, rent or lend user lists or personal data to third parties.

We do not consider data that we have anonymized or aggregated so that you can no longer be identified as a natural person to be personal data.

If we close your user account in accordance with the terms of use of our services, e.g. in the event of a breach of the terms of use or if you do not confirm your intention to continue using the services after three years of inactivity, we will initiate the deletion of your data and retain it only for as long as we are legally obliged to do so, in accordance with the time limits set out in the section on the right to erasure and restriction of processing.

WITH WHOM DO WE SHARE YOUR DATA?

We only share your data with partners who are contractually bound to Booking-Kroatien.de and only to the extent necessary to provide certain services.

All persons who have access to your data, as well as our partners, are contractually obliged to maintain confidentiality and must comply with organizational and technical protective measures.

With Internet users and Booking-Croatia.com – you can decide for yourself which personal data you want to make public or share with other users when you use our services.

Third parties will only process your data:

  • to provide services to Booking-Kroatia.com, such as payment services, data analysis, sending electronic or physical mail, customer support, data verification, fraud and money laundering prevention, advertising accommodation on tourism portals, as well as contracting and providing accommodation services;
  • to provide services for Booking-Kroatien.de, such as hosting, IT services, accounting services as well as services of lawyers, auditors and other consultants. 

Data transmission to fulfill legal requirements:

We may share your information with third parties in accordance with applicable law in order to:

  • to comply with legal regulations, ordinances or other legal requirements,
  • prevent, detect or solve fraud and security problems.

Transfer of data to third countries outside the EU:

In the case of data transfer to third countries, data protection is guaranteed in accordance with the applicable European regulations and additional contractual agreements in accordance with the recommendations of the European Data Protection Board. If the European Commission determines that the recipient country does not offer an adequate level of data protection, we will take additional measures such as data anonymization, risk analyses for the transfer and inform you of this in this policy.

WHICH COOKIES AND TOOLS DO WE USE?

We use various tools to analyze visitors and user behavior on the Booking-Croatia.com website in order to better understand your needs and improve the quality of our services.

Types of cookies we use:

  • Our cookies and the cookies of our partners: These cookies recognize your device to provide you with a better service and display ads that match your interests. The technical data collected, such as cookies, IP addresses or device identifiers, are not linked to your personal data and do not enable the identification of individuals.

Management of cookies via the Didomi tool:

  • We use the Didomi tool, which allows you to view all the types of cookies we use, along with the purpose of each cookie. The Didomi tool allows you to choose which cookies may be used, according to your needs and preferences. You can adjust these settings on our website and in the mobile applications.

Za objavu sadržaja koji bi Vas mogli zanimati i za komunikaciju koristimo poslovne profile i stranice na društvenim mrežama kao što su Facebook, Instagram (u vlasništvu Meta Platforms, Inc.), YouTube (Google LLC) i Twitter. Prilikom Vaših interakcija na ovim platformama možemo prikupljati i obrađivati Vaše podatke, ali ih ne pohranjujemo unutar naših sustava.

Kako postupamo s podacima na društvenim mrežama:

  • Odgovorne osobe za upravljanje našim društvenim mrežama imaju uvid u primljene poruke i objave, a iznimno ih možemo pohraniti ako zakonski propisi to zahtijevaju.

HOW CAN YOU EXERCISE YOUR RIGHTS?

You can send us your request to exercise your rights directly, e.g. erasure, rectification of data, restriction of processing, data portability and access to data.

Complaints and further information: If you have a complaint about data processing or questions about your rights, you are welcome to contact us. If the complaint is not successfully resolved, you have the right to contact the competent data protection authority.

Confirmation of identity: In order to fulfill your request, we may need to confirm your identity. If this is not possible based on the available data, we will request a partial copy of an identification document for identification purposes.

Access to data of other controllers: If you use Booking-Croatia.com on behalf of another person or company, the request to exercise the rights can only be made with the authorization and request of that person or company. In cases where we use services of other providers acting as data controllers, their privacy policies define what data is collected and for what purpose. We recommend that you read all about the data protection policies of these providers before using these services.

RIGHT TO ERASURE AND RESTRICTION OF PROCESSING

You may at any time request the deletion of your personal data collected via the Booking Croatia services or the restriction of their processing in part or in full.

If you have an account with Booking-Croatia.com, you can request account closure and data deletion via the user interface My profile user interface. If you have active transactions within the Booking-Croatia.com services, we will inform you about the completion of these transactions before the account is finally closed and the data deleted.

Upon receipt of your request, we will inform you of its receipt and initiate the process of closing the user account and deleting the data. Unauthorized attempts to close the account and delete the data can be revoked within 24 hours. If you do not have a user account because you have used the services without registering (e.g. booking accommodation), you can send the request from the e-mail address you used for the service to hello@booking-kroatien.de.


THROUGHPUT TIME OF DATA STORAGE AND RESTRICTION OF PROCESSING

We store data in accordance with the applicable regulations and legitimate interests in connection with the use of Booking Croatia and delete it after the period has expired. For example:

  • Financial records and invoices are kept for the period required by law.
  • Data for fraud prevention or for processing complaints is stored for up to two years.
  • Delivery data is stored for six months.

If the deletion period is extended for technical or other reasons, we will notify you in writing. Once the data has been deleted, the user name will be anonymized and can no longer be used.

You can restrict the use of your e-mail address for sending notifications and advertising material at any time, as well as change the data and settings in the user interface My profile user interface or unsubscribe via the link in the e-mails.

RIGHT TO DATA PORTABILITY

As the owner of an active user account, you have the right to request the transfer of your data and content to another service provider at any time.

You can download your data yourself via the My Profile user interface.

The data that you can download in digital form includes:

  • Your contact details
  • Ads that are available when you log in to your Booking Croatia account

I protect the privacy of my users and do not allow the downloading of content that could violate your rights or the rights of other users.

Due to technical limitations, I cannot provide an automated data transfer service to another provider.

RIGHT TO INFORMATION (ACCESS TO DATA)

As the owner of your data, you have the right to information about what data I store or process and you can submit a request for further information.

You can view your basic data in the My Profile user interface for registered users.

If you would like more information or are not a registered user of Booking-Kroatien.de, please send me a request in writing to my address or by e-mail to hello@booking-kroatien.de.

RIGHT TO RECTIFICATION OF DATA

It is important that you have accurate data, so you should check it regularly.

To help you, we may perform data accuracy checks to the extent technically and legally permissible, such as verifying phone number, e-mail address and other data. We will send you reminders about the importance of using correct data and ask you to correct your data via the My Profile user interface.

You can correct the OIB and country in your profile by sending a written request from the e-mail address registered in your user account to hello@booking-kroatien.de or to your sales consultant.

If you do not have a user account or cannot change your e-mail address via My Profile, please send us a written request to my address or by e-mail to hello@booking-kroatien.de.

Please note that you cannot change the user name. It is therefore important that you choose a user name and password carefully.

CONNECTIONS WITH OTHER SITES

On Booking-Croatia.com you will find links that will take you to the sites of other service providers to which my privacy policy does not apply. When you leave the pages of Booking-Croatia.com via a link, I ask you to familiarize yourself with their privacy policy and how they protect your personal data.

NOTE ON CHANGES AND CONTACTS

Occasionally, I may change these rules, and changes to the policy will be posted along with this Privacy Policy on the Booking-Croatia.com page. In the event of significant changes, we will inform you of the changes in an appropriate manner, and previous versions can be requested via the contact form.

By registering or continuing to use Booking-Croatia.com after changes to the policy, you confirm that you are familiar with the applicable rules and consent to the processing of your data for the stated purposes.
